BaFin doesn’t issue fines for punchy hooks. It issues fines for specific words, in specific contexts, without specific disclaimers. Here’s the working checklist our compliance team runs every script through.
1. Never promise a return without a time window. “20% is realistic” is fine, “20% guaranteed” is a takedown.
2. Any mention of a specific product needs a “risk of total loss” line within 3 seconds. Voice-over or overlay both count.
3. The word “Anlageberatung” (investment advice) is a landmine — replace with “meine persönliche Meinung” when speaking as an individual.
4. Sponsored crypto content has its own rule set. If you cover crypto sponsors, message the compliance team before the script goes into production.
